Probate

What does probate mediation offer?

Probate, estate and trust disputes can be amongst the most emotive, difficult and expensive cases to resolve. When dealing with the division of wealth, family dynamics can combine with emotion, misunderstanding and legal complexities to create a wide variety of challenging situations and competing interests.

Legal resolutions are rarely ideal, consuming large amounts of money and extending the dispute over a lengthy period. Often the underlying issues are not addressed.

Mediation can offer parties a valuable opportunity to reach a solution without wasting valuable resources, and prolonging disputes.

Mediation assists by exploring all possible options, including new proposals for settlement that have never been considered.

The mediator who is absolutely independent and has no stake in the outcome can help the parties to reach a solution that meets everyone’s needs.

Confidentiality in the process enables the parties to be candid in explaining their concerns to the mediator without damaging any negotiations or compromising their position.

The mediator does not judge or give advice but helps the parties reach a settlement by using a variety of techniques to break deadlock and create the right environment to enable a settlement.

Parties are often surprised that such complicated disputes with a long history could be capable of resolution in just one session.

The mediation process is straightforward, easy to arrange and can be set up with one telephone call.
